§1 Contract Parties, Business Activity Range

The GODOX online shop, which presents a selection of goods for sale on the godox-direct.co.uk website, will henceforth be known as the Shop. The entity owning the Shop is the company:

The secondary party to the agreement, conducting purchases through the Shop, will be referred to hereafter as the Customer. The Shop provides sales and deliveries to the Customer in accordance with these Rules. When the Customer places an order through the Shop, they thereby agree to these rules.

Every product available in the Store is brand new (unless otherwise specified) and comes with a warranty provided by the manufacturer or their authorized representative.

§2 Finalizing the Agreement

The entirety of the content and commercial data on the website https://godox-direct.co.uk is presented as an invitation to establish a contract under the context of Article 71 of the Civil Code, rather than constituting an enforceable contract. This is applicable to all products being offered.

To obtain a VAT invoice, kindly furnish the necessary invoice details during the ordering process and opt for the relevant option. If not, you will be provided with a fiscal receipt. The Client, by placing an order, consents to the Store's processing of their email address and personal information necessary for the execution of the order, in compliance with the applicable guidelines of the Data Protection Act of August 29th, 1997.

An individual who places an order in the Store must be a legal adult (over the age of 18) and possess full legal capacity to conduct lawful transactions. If there are significant inaccuracies on the website https://godox-direct.co.uk or an order confirmation includes serious mistakes (defined as situations that lead the Store to unjustifiably make a judgement and enter into a contract under a mistake) related to the product price or contract terms, and the Customer was aware of or could have easily detected such errors, or if the Customer caused such a mistake, the Store may avoid the legal consequences. In this case, all parties will return all mutual benefits.

§3 Information on Product Prices and Details

The display of product prices and details on the www.godox-direct.co.uk site merely serves as commercial information and should not be treated as an official offer under the Civil Code. They only become legally binding once the Store approves an order.

All listed prices on the website are total amounts inclusive of VAT as per the norms of tax law.

Delivery charges are calculated separately at the time of order placement. Estimated delivery costs can be checked by the Customer under the shipping/delivery section.

The Store holds accountability only for the product prices and their details displayed on its official website at www.godox-direct.co.uk. It is recommended to cross-check the prices and details from other platforms (including price search engines, etc.) with the official Store’s website.

§4 Payment

§5 The right to withdraw from the contract

A consumer is defined as an individual who engages in a transaction with a business that is not directly related to their own business or professional activities, as per the Civil Code. The Act of May 30, 2014, on consumer rights, entitles the consumer to cancel the contract within 14 days without stating any reason. To exercise this right, the consumer must notify the Store of their decision with a clear statement. They can use a standard withdrawal form, which is not mandatory, and send it along with the goods and purchase proof to the GODOX address. Sending the information regarding contract withdrawal before the 14-day window is enough to meet the deadline. The store will immediately confirm the receipt of the withdrawal notification.

If the contract is cancelled, the Store will refund all payments including delivery costs (excluding extra costs from choosing a different delivery method than the cheapest standard one offered by the Store), within 14 days from the day they were informed about the withdrawal. The refund will be made using the same payment method used in the original transaction unless the Consumer agrees to a different method.

The consumer is required to return the item promptly, within 14 days from the day they cancelled the contract. Returning the items before this period is deemed as meeting the deadline. The store may withhold the refund until they receive the item or proof of its return, whichever comes first.

If the returned goods are in a condition that doesn't exceed ordinary use, the Store will refund the product's value and delivery cost to the customer. The cost of returning the goods under the right to contract withdrawal falls on the customer.

To expedite the withdrawal process, it's recommended to attach a printed statement to the returned goods. The products must be returned in their original, undamaged packaging to reduce the risk of damage during transit.

The customer is responsible for the direct costs of returning the goods (i.e., shipping the goods back to us).

Please note, due to the Stripe payment system's processing, SEPA payment refunds can't be issued earlier than 8 weeks after the payment was made. All orders paid by SEPA may take an additional 3-4 days to process compared to other payment methods.

§6 Shipping Policies

Products are dispatched to the customer's specified address via courier service (Royal Mail, Hermes) from our warehouse.

For smoother transaction processing, when paying via a bank transfer, the customer should mention their full name and order number in the payment reference. If an order has been placed with the prepayment option and payment isn't received within 7 days, the order and its confirmation will be invalidated, requiring the customer to reorder.

Order processing encompasses both package preparation and delivery times. We strive to dispatch products as quickly as possible, exclusively on business days. If the product is in stock, the standard processing time is 1 to 3 business days. If the product is out of stock, the customer will be notified about the possible delay either by email or phone. In rare cases, processing may take longer.

Orders are processed only if the products are available in the warehouse or from the shop's suppliers. If some products are unavailable, the customer will be notified about the order status and can decide on the next steps. We aim to inform the customer within 30 days of such occurrences but will make every effort to minimize this duration.

If the product is unavailable or the order can't be processed, the customer will be informed within 30 days. The customer can then decide whether to wait for product availability or cancel the order. In case of cancellation and if the order has been prepaid, the store will immediately initiate a refund via the same payment method used by the customer.

§7 Handling Transportation Damages

If the customer's package arrives with visible damage, a damage report should be drawn up in the courier's presence to establish liability. This report will help determine when the damage likely occurred during transportation. Timely creation of this report expedites the resolution process.

Customers can refuse to accept damaged packages and should promptly inform the store of such incidents. If the damage isn't externally visible, the customer should immediately notify both the courier and the store via email at sales@godox-direct.co.uk. The store will then take the required steps to resolve the issue.

§8 Guarantee Provisions

The assurance is executed through the store or, upon customer's request, directly with the manufacturer. Any trademarks, details, names, or logos belong to their respective holders and are displayed on the website purely for informational reasons.

If a product comes with a warranty granted by the manufacturer or distributor, the customer has the right to lodge a complaint against a faulty product by:

  • - Exercising the rights provided by the warranty,
  • - Utilizing the rights granted to them by the seller under the warranty.

Under the warranty, the store is answerable for physical and legal defects of goods as outlined in Article 556 and succeeding sections of the Act of 23 April 1964 - Civil Code.

A physical defect refers to any discrepancy between the sold item and the contract. This includes if the item lacks the properties it should have according to the contract's purpose, circumstances, or destination. It also includes if the item lacks the properties that the store has assured the customer of, or if it's unsuitable for the stated purpose that the customer informed the store about at the time of contract conclusion and to which the store did not object. It also applies if the item was delivered to the customer in an incomplete condition.

Complaints about defects that occur within the warranty period will be evaluated within 21 days from the point the store receives the returned goods. However, the store will reply to the customer's letter concerning the warranty claim within 14 days of receipt. If the equipment needs to be sent to a specialized service or requires time-consuming tests, this period can be extended by an additional 21 days. The customer must include a document verifying the purchase from our store (such as a fiscal receipt, VAT invoice) and a filled-out complaint form (a complaint form can be downloaded).

A situation of legal defect may arise if the purchased item is owned by a third party or is burdened with the rights of a third party, or if the use or disposal of the item is restricted due to a decision or judgement made by a competent authority. If a customer finds a defect in the item, they have the right to request a price reduction or to withdraw from the contract, unless the Store promptly provides an item replacement or rectifies the defect. However, this doesn't apply if the Store has already replaced or repaired the item or has failed to fulfil the obligation to replace the defective item or rectify the defect.

Customers also have the right to request the Store to replace the defective item or to rectify the defect. Instead of the Store's proposed solution to rectify the defect, the customer can demand a replacement of the item with a non-defective one, or vice versa. However, the chosen method of bringing the item into compliance with the contract shouldn't be impossible or incur excessive costs compared to the Store's proposed method. If the defect is minor, the customer may not withdraw from the contract.

The claim to rectify a defect or replace a defective item lapses after one year from the discovery of the defect, but in the case of a consumer, this period cannot end before two years. For the Store to investigate the complaint, the customer should return the defective product along with proof of purchase and a description of the complaint.

Complaints about defects that occur within the warranty period are processed within 21 days from the moment the Store receives the returned goods. However, the Store will respond to the customer's warranty claim letter within 14 days of receiving it. If additional testing or sending the equipment to a specialist service is required, the processing time may extend by another 21 days. The customer should include a purchase receipt and a completed complaint form with the returned item.

The Store's warranty doesn't cover maintenance as per the operating manual, damage from accidents or lightning, damage from improper usage, damage from unauthorized servicing, mechanical damage, or consumables like bulbs, batteries, etc. The Store does not accept any parcels sent COD.

Other clauses include the right of the customer to return used electrical or electronic equipment of the same type when buying a new item.
